Sublease agreement — do it the legal way

Get the landlord’s written consent first

In most jurisdictions you cannot sublet without the landlord’s permission — and they can’t refuse unreasonably. Some provinces (e.g. Quebec) have a specific statutory sublease process. Get consent in writing before you sign anything.

The sublease can’t outlast your own lease

A sublease term must end on or before your head (original) lease ends. You can’t grant more than you hold.

You stay on the hook

As the original tenant you normally remain fully liable to your landlord for rent and damage, even after you sublet. If your subtenant doesn’t pay, the landlord looks to you.

Sublease vs. assignment

A sublease is temporary and you keep the head lease; an assignment transfers your lease entirely. They have different consequences — pick the right one.

Same jurisdiction rules as a lease

Deposit limits, notice periods, and required disclosures for your province or state still apply to the sublease.
